Welcome to PodcastOne. These Terms & Conditions ("Terms") govern your access to and use of podcastone.com, the PodcastOne mobile applications, and all related services (collectively, the "Services") provided by PodcastOne, Inc. ("PodcastOne," "we," "us," or "our").
Please read these Terms carefully. By using the Services, you agree to be bound by them. If you do not agree, do not use the Services.
You must be at least 13 years old to use the Services. If you are under 18, you may use the Services only with the involvement and consent of a parent or legal guardian. You represent that all information you provide is accurate and that you have the legal capacity to enter into these Terms.
Some features require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at support@podcastone.com if you suspect unauthorized use of your account.
PodcastOne offers paid subscriptions, including PodcastOne Premium ("Premium"), which are sold through third-party platforms (such as Apple's App Store, Google Play, or other authorized partners). Any purchase you make is subject to the terms and billing practices of the platform through which you subscribe, including their auto-renewal, cancellation, and refund policies.
We are not responsible for billing, renewals, or cancellations processed by third-party platforms. To manage or cancel a subscription, follow the instructions provided by the platform where you subscribed.
All content on the Services—including podcasts, audio recordings, video, artwork, text, logos, trademarks, and software—is owned by PodcastOne, our licensors, or our content partners and is protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and stream the Services for your personal, non-commercial use. You may not copy, download, modify, distribute, publicly perform, republish, or create derivative works from the content without our prior written permission or as expressly permitted by applicable law.
The PodcastOne name, logo, and related marks are trademarks of PodcastOne, Inc. Third-party trademarks are the property of their respective owners.
We respect the intellectual property rights of others and expect our users to do the same. If you believe that material on the Services infringes your copyright, please send a written notice to our Designated Copyright Agent that includes:
A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
Identification of the copyrighted work claimed to have been infringed;
Identification of the material that is claimed to be infringing and information reasonably sufficient to locate it;
Your contact information (address, telephone number, and email);
A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

We may remove or disable access to material claimed to be infringing and will terminate the accounts of repeat infringers where appropriate. If you believe your content was removed in error, you may submit a counter-notice under 17 U.S.C. § 512(g).
When using the Services, you agree not to:
Violate any law, regulation, or these Terms;
Infringe the intellectual property or other rights of any person or entity;
Upload or transmit viruses, malware, or other harmful code;
Interfere with or disrupt the Services or servers;
Access the Services through automated means (bots, scrapers, crawlers) except with our written consent;
Attempt to gain unauthorized access to any part of the Services;
Impersonate any person or entity or misrepresent your affiliation;
Post or transmit content that is unlawful, threatening, harassing, defamatory, obscene, or otherwise objectionable;
Use the Services to send unsolicited communications or advertising; or
Use the Services in any manner that could disable, overburden, damage, or impair them.
If you submit comments, ratings, suggestions, or other content to the Services ("User Content"), you grant PodcastOne a worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, publish, distribute, and display that content in connection with the Services and our business. You represent that you own or have the necessary rights to the User Content you submit and that it does not violate these Terms.
We reserve the right, but have no obligation, to monitor, edit, or remove User Content at our discretion.
The Services use cookies, pixels, and similar technologies to operate the site, remember your preferences, measure audience engagement, and deliver relevant advertising. By using the Services, you consent to our use of these technologies. You can manage cookies through your browser settings or the cookie preferences link on our website. For details on what we collect and how we use it, see our Privacy Policy.
The Services contain links to, and are distributed through, third-party platforms (including Apple Podcasts, Spotify, YouTube, Amazon Music, and iHeartRadio). Your use of those platforms is governed by their own terms and privacy policies, and we are not responsible for their content or practices.
The Services are supported in part by advertising. By using the Services, you agree that we and our advertising partners may display advertisements and promotional content, which may be personalized based on information about you and your use of the Services.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We make no warranties regarding the accuracy or reliability of any content available through the Services.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PODCASTONE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total aggregate liability arising out of or relating to these Terms or the Services shall not exceed one hundred U.S. dollars ($100).
You agree to indemnify, defend, and hold harmless PodcastOne, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Services, your User Content, or your violation of these Terms or applicable law.
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Services immediately ends. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will remain in effect.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.
Class action waiver. You and PodcastOne agree that any dispute will be resolved on an individual basis, and neither party may pursue any claim as a class, collective, or representative action.
We may modify these Terms at any time by posting the updated version on this page. Material changes will be communicated through the Services or by email where appropriate. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and PodcastOne regarding the Services.
Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
No waiver. Our failure to enforce any provision of these Terms will not constitute a waiver of that provision.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms at any time without notice.
